Анотація
У статті висвітлено особливості фінансового регулювання криптовалютного ринку в країнах Європейського Союзу. Зокрема, розкрито класифікацію криптоактивів, ключові цілі та вимоги Регламенту MiCA до криптовалютного бізнесу, емітентів та оферентів криптоактивів. Особливий акцент зосереджено на дослідженні досвіду розробки польського законодавства з регулювання ринку криптоактивів та можливостях його використання в Україні. Зроблено критичний аналіз ключових положень вітчизняного законопроєкту про легалізацію та оподаткування криптовалюти в Україні, визначено його переваги і ризики для держави, бізнесу та дрібних користувачів послуг. Запропоновано основні напрями удосконалення законодавчої бази з регулювання ринку віртуальних активів в Україні.
The purpose of the article is to study the peculiarities of financial regulation of the virtual asset market, taking into account European experience, and to identify effective instruments of state control in Ukraine. The article argues that studying the financial regulation of the virtual asset market, taking into account European experience, is an important step towards creating an effective, balanced, and innovation-oriented financial policy for Ukraine in the context of the digital economy. The study found that the European Union has taken proactive steps to regulate the crypto market by adopting the Markets in Crypto-Assets (MiCA) Regulation. The article reveals the classification of crypto-assets, key objectives and requirements of the MiCA Regulation for the cryptocurrency business, issuers and offerors of crypto-assets. Particular emphasis is placed on studying the experience of developing Polish legislation on the regulation of the crypto-asset market and the possibilities of its use in Ukraine. It has been found that the Polish government and the Polish Financial Supervision Authority (PFSA) actively promote the use of blockchain technology in the country by providing support and advice to companies and startups exploring these innovative solutions. Therefore, according to the author, studying the Polish model of cryptocurrency market regulation is particularly important for Ukraine. A critical analysis of the key provisions of the domestic draft law No. 10225-d on the legalization and taxation of cryptocurrency in Ukraine has been made, and its advantages and risks for the state, business, and small service users have been identified. It has been established that legislative initiatives provide legal certainty in the cryptocurrency market, a tax base, and instruments of state control, but they also contain significant risks of excessive fiscalization, complications for small players, unregulated distribution of powers between regulators, etc. The article proposes the main directions for improving the legislative framework for regulating the virtual asset market in Ukraine, aimed at ensuring its transparency, accessibility, and maximum compliance with European standards.
