    Prevention of сriminal оffenses in the field of road safety

    The article is devoted to a comprehensive study of the criminal law and criminological principles of ensuring road safety in the context of increasing transport mobility and the complexity of the road environment. It reveals the role of international and European standards, including EU approaches, WHO guidelines and the “Safe System” concept, in shaping an effective model of combating transport crime. It is shown that the effectiveness of criminal law measures depends on their integration with preventive, infrastructural and organizational mechanisms, as well as on the proper quality of evidence and coordination between competent authorities. Special attention is paid to criminological factors underlying road safety offenses, emphasizing risk-oriented behavior of young drivers, personal characteristics, fatigue, socio-economic conditions and infrastructure deficiencies. The conclusion highlights the need to harmonize national legislation with European approaches, enhance preventive policy, implement digital risk-monitoring technologies and strengthen interagency cooperation to improve the prevention of criminal offenses in the field of road traffic.

    Prevention of transport-related crimes through urban planning improvements

    The article investigates the relationship between urban planning features and the crime level in Ukraine's transport sector. The research results showed that despite the development of technical security means and strengthened law enforcement control, the effectiveness of crime prevention remains insufficient. In this regard, the necessity of a systematic approach is substantiated, which includes architectural and planning solutions as an integral element of a preventive strategy. Based on the analysis of international experience and adaptation of the "Crime Prevention Through Environmental Design"concept to Ukrainian realities, the authors reveal the potential of urban planning tools in forming a safe transport environment. It is important to note that special attention is paid to lighting transport hubs, organizing pedestrian flows, visual surveillance, and creating open spaces that promote natural supervision. The authors analyze the legislative support for integrating security principles into urban planning and identify gaps in the regulatory framework. Additionally, the paper presents the results of sociological research on the perception of transport infrastructure safety by different population groups, allowing for consideration of the needs of the most vulnerable categories of transport users. It was found that the authors proposed a model for assessing transport infrastructure's safety, including quantitative and qualitative indicators. Thus, using several Ukrainian cities as examples, the possibilities of applying the developed recommendations are demonstrated, and the potential socio-economic effect of their implementation is calculated. On the other hand, the article contains specific proposals for improving state building codes, mechanisms of public control, and stimulating private investment in secure infrastructure. At the same time, the research materials can be used in developing urban planning documentation, improving educational programs for training specialists in urban planning and transport planning, and forming strategies for the sustainable development of settlements in Ukraine. However, it should be taken into account that the effectiveness of the proposed measures depends on a comprehensive approach to their implementation.

    Тема є актуальною через зростаючий масштаб збройних конфліктів і порушень прав людини, які наражають на небезпеку цивільного населення та міжнародну безпеку. У цьому контексті ідеологія людоцентричності, основа забезпечення прав і свобод людини, є критично важливою для захисту прав людини під час війни та стабільності післявоєнної реконструкції. Мета: Ця наукова стаття має на меті систематизувати механізми захисту прав людини у воєнний час на основі концепції людоцентризму, проаналізувати існуючі механізми захисту прав людини та оцінити загрозу для цивільного населення в контексті повномасштабного вторгнення Росії в Україну. Методи: У статті використано кілька загальних наукових методів дослідження, зокрема синтез, індукцію, дедукцію, порівняльний аналіз, систематизацію та узагальнення. Для проведення дослідження автор проаналізував наукову літературу та застосував статистичний аналіз для отримання початкових даних для подальшого прогнозування динаміки воєнних злочинів і проведення оцінки ризиків для цивільного населення за допомогою статистичного програмного забезпечення Excel.

    Правові механізми інтеграції українського містобудівного законодавства до acquis communautaire ЄС: проблеми та пріоритети гармонізації

    Дана стаття здійснює детальний аналіз юридичних інструментів та механізмів, котрі є запорукою успішної інтеграції вітчизняного містобудівного законодавства в систему «acquis communautaire»Європейського Союзу. Дослідження базується на ретельному порівнянні положень Закону України № 3038-VI «Про регулювання містобудівної діяльності» (від 17.02.2011 р., з подальшими змінами) з ключовими регуляторними актами ЄС, а саме: Директивою 2011/92/ЄС «Про оцінку впливу певних публічних і приватних проектів на навколишнє середовище», Директивою 2001/42/ЄС «Про оцінку впливу окремих планів та програм на навколишнє середовище, а також Регламентом (ЄС) № 1082/2006, що стосується європейського угруповання територіального співробітництва (ЄУТС).

    Observance of human rights under the conditions of national law adaptation to the norms of the european union

    Abstract: The article examines the issue of ensuring human rights when adapting the national legislation of Ukraine to the standards of the European Union. It was determined that the growing importance of international legal obligations encourages countries to adopt and implement EU norms, however, this process can generate conflicts with national legal systems, as well as human rights violations. The main aspects related to the observance of human rights in adapting national law to EU norms have been studied. Issues related to guarantees of freedom of thought, religion, human rights in the sphere of private life, and protection of personal data were analyzed. The need to regulate domestic procedures and control mechanisms to protect human rights has been identified. The necessity of maintaining a balance between the adaptation of national law to European standards and ensuring the protection of human rights on the basis of the development of monitoring mechanisms, the independence of the judicial system, and raising the legal awareness of society has been proven.

    Мediation in criminal processes in Ukraine

    The article examines the essence and significance of mediation in the criminal process of Ukraine. The peculiarities of using mediation to resolve conflicts between parties involved in a crime are analyzed. The role of the mediator in facilitating the achievement of a compromise and restoration of cooperation between the participants of the process is investigated. Special attention is paid to the advantages of mediation compared to traditional court procedures. The article examines the potential of mediation to reduce the burden on the judicial system and improve the satisfaction of the needs of the participants in the criminal process. It has been proven that in modern Ukrainian criminal justice, mediation is an essential element of alternative conflict resolution. The article considers the role of mediation in criminal cases and investigates its influence on improving the efficiency of justice. Mediation facilitates mutual understanding between parties, reducing court cases and restoring harmony in society. The positive aspects of the use of mediation in comparison with traditional court procedures are identified, such as efficiency, economy and preservation of relationships between participants in the criminal process.

    Сriminal procedural mechanisms for investigating crimes in the construction sector: current issues of proof and methodological approaches to their resolution

    This scientific study is dedicated to a comprehensive analysis of criminal procedural mechanisms for investigating crimes in the construction sector of Ukraine. The relevance of the chosen topic is due not only to the key role of the construction sector in the state's economy, which generates a significant part of the GDP and provides employment, but also to the high level of corruption risks, technological complexity of processes, specificity of legal relations, and significant financial volumes, all of which create a fertile ground for various criminal manifestations. These offenses not only undermine the investment climate and trust in state institutions but also pose a direct threat to the safety of citizens, who are the ultimate consumers of construction services, and cause significant economic losses. Objective. The research aims to comprehensively identify and in-depth analyze current problems of proof in criminal proceedings related to crimes committed in the construction sector of Ukraine, as well as to develop scientifically substantiated, practically applicable methodological approaches for their effective resolution. To achieve this goal, the following tasks were set: to analyze current criminal procedural legislation and special regulatory legal acts, to study relevant judicial practice, and to develop comprehensive recommendations for improving investigative and evidentiary activities.

    Social and economic factors of criminal offenses in transport security

    This scientific article is devoted to a deep and comprehensive analysis of the social and economic factors that significantly influence the dynamics and nature of criminal offenses in the field of transport security in Ukraine during the period 2020-2025. The work presents generalized conclusions and a detailed overview of statistical data illustrating key changes in the structure and dynamics of transport crimes. Special attention is paid to studying the impact of the armed conflict that began in 2022 on the criminogenic situation in the transport sector, highlighting new challenges and peculiarities that arose as a result, including the increasing number of thefts, looting, and illegal transportation of goods in frontline areas, as well as the activation of criminal groups that exploit complicated logistics and the security situation for their purposes. The study examines how changes in the social environment caused by the war, such as forced displacement, the breakdown of social ties, and psychological tension, contribute to the increase in crime levels in transport. Within the study framework, key determinants of crime in the transport sector have been identified and systematized, including unemployment, migration processes, social stratification, and changes in the economic conjuncture. It analyzes how rising unemployment and declining living standards push specific segments of the population to illegal actions in transport, and how migration flows create new conditions for criminal groups, including cross-border crime and human trafficking. The impact of the shadow economy and corruption schemes on increasing transport crime is examined particularly by creating favorable conditions for smuggling, illegal arms and drug trafficking, and illicit passenger and cargo transportation. Emphasis is placed on identifying regional peculiarities of these factors' manifestation, considering geographical location and the degree of impact by military actions. Based on the results, a set of practical measures to counteract and prevent these offenses is proposed, which can be implemented at both the legislative and practical levels.
